By downloading, accessing, registering for, or using the ResQ application, website, marketplace, or related services (collectively, the “App” or “Platform”), you agree to be bound by these Terms & Conditions. Please read them carefully before use. If you do not agree with any part of these Terms, you should not use the Platform.
1. USE OF THE APP
The App and all associated intellectual property, including trademarks, copyrights, database rights, logos, software, and content, are the exclusive property of ResQ or its licensors.
You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for its intended purpose in accordance with these Terms.
You may not:
- Copy, modify, distribute, or reproduce the App or any part of it;
- Reverse engineer, decompile, disassemble, or attempt to extract the source code of the App;
- Create derivative works or translations;
- Use ResQ trademarks, branding, or intellectual property without prior written consent; or
- Use the App for any unlawful, fraudulent, abusive, or unauthorized purpose.
2. PLATFORM SERVICES
ResQ operates a technology platform that:
- Connects users with independent service providers offering towing, roadside assistance, recovery services, marine assistance, water delivery, mechanical services, and other related services; and
- Facilitates a marketplace through which users and vendors may advertise, buy, and sell products and goods, including second-hand items and vehicle parts.
Unless expressly stated otherwise, ResQ does not directly provide the services offered through the Platform and is not generally the seller, supplier, manufacturer, distributor, or owner of goods listed on the marketplace.
Service providers, vendors, and sellers are independent businesses or individuals and are solely responsible for the services and products they provide, including pricing, descriptions, quality, condition, safety, legality, warranties, delivery, licensing, insurance, and compliance with applicable laws.
ResQ does not guarantee the availability, quality, suitability, condition, authenticity, ownership, legality, or performance of any service or product offered through the Platform.
Users are responsible for exercising reasonable judgment before engaging a service provider, purchasing goods, or entering into transactions through the Platform.
3. ADDITIONAL POLICIES
Your use of the Platform is also governed by the following policies, which are incorporated into these Terms by reference:
- Privacy Policy;
- Refund & Cancellation Policy; and
- Any additional marketplace, subscription, promotional, or vendor-specific terms that may apply to particular services or transactions.
By using the Platform, you acknowledge that you have read and agree to these policies.
4. MODIFICATIONS AND CHARGES
ResQ reserves the right to modify, update, suspend, or discontinue the Platform or any part of it at any time.
ResQ may introduce charges, fees, subscriptions, commissions, or other payment arrangements for certain services or features. Any applicable charges will be clearly communicated before they are incurred.
5. PERSONAL DATA AND SECURITY
The Platform stores and processes personal data that you provide in order to deliver services and facilitate transactions.
By using the Platform, you consent to the collection, use, and processing of your information in accordance with the Privacy Policy.
You are responsible for:
- Maintaining the security of your device and account credentials;
- Protecting access to your account;
- Promptly notifying ResQ of any unauthorized access; and
- Ensuring your device remains secure and free from unauthorized modifications.
ResQ is not responsible for security issues resulting from device modification, jailbreaking, rooting, malware, or user negligence.
6. THIRD-PARTY SERVICES
The Platform may integrate with or rely upon third-party services, including payment processors, mapping services, app stores, communication providers, analytics providers, and other technology partners. Such third-party services may have their own terms, conditions, and privacy policies.
ResQ is not responsible for the operation, availability, security, or content of third-party services.
7. CONNECTIVITY AND CHARGES
Certain Platform functions require internet access through Wi-Fi, mobile data, or other network connections.
ResQ is not responsible for service interruptions caused by connectivity issues, network outages, device limitations, or telecommunications failures.
You are solely responsible for any mobile data, roaming, messaging, or telecommunications charges incurred while using the Platform.
8. USER RESPONSIBILITY
You are responsible for maintaining your device, account information, and access credentials.
ResQ is not liable for losses resulting from:
- A device running out of battery;
- Loss of internet connectivity;
- Unauthorized access resulting from your actions or omissions; or
- Your failure to maintain your device or account security.
9. PAYMENTS
Where payments are processed through the Platform, users authorize ResQ and its designated payment service providers to process payments relating to services, products, subscriptions, fees, and other transactions facilitated through the Platform.
ResQ may facilitate the collection and settlement of payments on behalf of participating vendors and service providers.
Payment disputes relating to services or products should generally be raised directly with the relevant vendor, seller, or service provider.
Refunds and cancellations are governed by the ResQ Refund & Cancellation Policy.
10. RELIANCE ON THIRD-PARTY INFORMATION
While ResQ seeks to maintain accurate and current information, certain content, listings, descriptions, pricing, availability, reviews, and other information may originate from third parties.
ResQ does not warrant the accuracy, completeness, or reliability of third-party information and accepts no liability for losses resulting from reliance upon such information.
11. APP UPDATES AND SUPPORT
The Platform is available on supported operating systems and devices.
ResQ may:
- Issue updates, upgrades, patches, and modifications;
- Change technical requirements;
- Discontinue support for older devices or operating systems; and
- Discontinue the Platform or any feature at any time.
By using the Platform, you agree to install updates where required for continued functionality.
12. LIMITATION OF LIABILITY
To the fullest extent permitted by law, ResQ shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or economic losses arising from or relating to:
- Use of or inability to use the Platform;
- Services performed by independent service providers;
- Products purchased through the marketplace;
- Delays, interruptions, outages, or technical failures;
- Conduct of vendors, sellers, customers, or other users;
- Inaccurate listings, descriptions, pricing, or reviews; or
- Any act or omission of a third party.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
13. SUSPENSION AND TERMINATION
ResQ reserves the right to suspend, restrict, or terminate access to the Platform at any time where a user:
- Breaches these Terms;
- Engages in fraudulent, unlawful, abusive, or deceptive conduct;
- Misuses the Platform;
- Interferes with other users; or
- Creates legal, operational, financial, or reputational risk.
Upon termination, all rights granted under these Terms will immediately cease and users must discontinue use of the Platform.
14. CHANGES TO THESE TERMS
These Terms & Conditions are effective as of June 2026. ResQ may amend these Terms from time to time. Updated versions will be published through the Platform or website.
Continued use of the Platform after publication of revised Terms constitutes acceptance of the revised Terms.
15. GOVERNING LAW
These Terms & Conditions shall be governed by and construed in accordance with the laws of Bermuda.
Any dispute arising out of or relating to these Terms or use of the Platform shall be subject to the exclusive jurisdiction of the courts of Bermuda.
